Beau Event Photos - Photo Booth Hire Terms and Conditions These Terms and Conditions ("Terms") govern the hire of photo booth equipment and services provided by Beau Event Photos ("we," "us," or "our") to the client ("you" or "your"). By booking our services, you agree to be bound by these Terms. 1. Booking and Payment •1.1 A booking is considered confirmed upon our receipt of a booking form or confirmation email (digital or physical) and payment of the non-refundable deposit as specified in our quotation. •1.2 The remaining balance is due prior to the event date. •1.3 Payment can be made via Paypal invoice (+ transaction fee) bank transfer, credit/debit card, online payment methods and cash. Whilst we are willing to help clients take advantage of payments instalments offered by PayPal and Klarna an additional fee maybe added to your invoice. •1.4 If the final balance is not received by the due date, we reserve the right to cancel the booking without notice and without refunding the deposit. 2. Services Provided •2.1 We will provide the photo booth equipment and, if applicable, an attendant, as detailed in the booking confirmation. •2.2 Our services include: oPhoto booth setup and takedown at the agreed-upon location. oUse of the photo booth for the agreed-upon hire period. oUnlimited photo sessions during the hire period, subject to pre agreed print limits (see clause 5). oA selection of fun props for use in the photo booth. oDigital copies of all photos taken (see clause 6). •2.3 We will make reasonable efforts to arrive and set up at the agreed time. However, we shall not be liable for any delays caused by circumstances beyond our reasonable control, such as traffic delays or venue access issues. Where possible we will extend the run time of the booth if suitable. 3. Client Responsibilities •3.1 You are responsible for providing a suitable location for the photo booth, including adequate ceiling height for chosen backdrops and (as specified in our quotation) and access to a reliable power supply. •3.2 You must obtain any necessary permissions or consents from the venue for the use of the photo booth. •3.3 You are responsible for the conduct of your guests and ensuring that they use the photo booth and props in a safe and responsible manner. •3.4 You are responsible for ensuring the safety of our equipment while it is at the event location. 4. Equipment and Backdrop •4.1 All equipment provided by us remains our property. •4.2 You are responsible for any loss or damage to our equipment (other than fair wear and tear) caused by you or your guests. •4.3 You will be liable for the full replacement cost of any damaged or lost equipment, including, but not limited to, the photo booth, camera, printer, and any accessories or props. •4.4 You are responsible for any damage to the backdrop, and will be charged the full replacement cost. 5. Prints & Guest Book •5.1 The service is subject to fair pre specified print usage. Under no circumstances do we offer unlimited prints. (See Print Guide) •5.2 To ensure all guests have fair access, we reserve the right to limit the number of prints per photo booth session. •5.3 Typically, this means one print per person in the photo, with a maximum of 10 prints per session. We retain the right to alter this at our discretion. •5.4 Print failure. From time to time machinery breaks down. The ‘cost’ price of the printing aspect of the booth rental will be refunded unless you’d prefer prints posted to you after the event. •5.5 We will facilitate Guest Book completion where reasonably possible and accept no responsibility for guest not wanting to make an entry. A suitable table needs to be organised by the hirer. An additional attendant maybe requested at a rate agreed with the hirer. 6. Supply of Images •6.1 We will provide you with digital copies of all photos taken at the event. •6.2 These images will be made available to you via the Lumabooth online gallery, and or via a pic time link with enhanced versions 1 or 2 days after the event. Onedrive upload is available also. •6.3 We will store the digital images for a period of 30 – 90 days subject to prior agreement. After this time, the images may be deleted without further notice. •6.4 You are responsible for downloading and backing up the images once they are provided. •6.5 We retain the copyright to all photos. We may use the photos for promotional purposes, unless you specifically request in writing that we do not. 7. Prop Return •7.1 All props provided by us remain our property and are for use during the event only. Props should not be taken back to tables and kindly request that guardians of children make sure props are returned and not misused. •7.2 You are responsible for ensuring that all props are returned to us in the same condition as they were provided, at the end of the event. •7.3 A designated area for prop return will be provided. •7.4 You will be charged the full replacement cost for any props that are lost, stolen, or damaged. •7.5 A general commonsense approach will maintained in the name of providing a fun service but respect for our business is appreciated. 8. Wi-Fi Problems •8.1 If social media sharing is included in your package, this service relies on a stable internet connection. •8.2 We will attempt to use the venue's Wi-Fi. You are responsible for ensuring the venue's Wi-Fi is available and accessible and any charges are liable by the hirer. •8.3 We are not responsible for poor or unavailable Wi-Fi service at the venue, which may affect social media sharing. •8.4 If the venue does not provide Wi-Fi, we offer a tethered mobile Smarty sim which is subject to network coverage, availability. •8.5 No refunds will be given if social media sharing is unavailable due to Wi-Fi issues with all images available when a suitable signal is possible. 9. Cancellation •9.1 If you cancel the booking, your deposit will be forfeited unless rescheduling to an available date. •9.2 If you cancel the booking within 45 days of the event date, you will be liable for the full cost of the booking. Certain circumstances will be taken into account. •9.3 We reserve the right to cancel the booking in the event of circumstances beyond our reasonable control (e.g., equipment failure, staff illness, or other unforeseen circumstances). In such cases, we will refund all monies paid, but we will not be liable for any consequential loss or damage. 10. Liability •10.1 Our liability to you for any breach of these Terms or any negligence on our part shall be limited to the total cost of the booking. •10.2 We shall not be liable for any indirect or consequential loss or damage, including, but not limited to, loss of profits, loss of enjoyment, or any travel or accommodation costs. •10.3 We are not responsible for any injury or damage caused by guests while using the photo booth, or props. 11. Indemnification •11.1 You agree to indemnify and hold us harmless from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or in connection with: oYour use of our services. oAny breach of these Terms by you or your guests. oAny damage to our equipment or the venue caused by you or your guests. 12. Force Majeure •12.1 We shall not be liable for any failure to perform our obligations under these Terms if such failure is caused by circumstances beyond our reasonable control, including, but not limited to, acts of God, war, terrorism, fire, flood, or industrial dispute. 13. Data Protection •13.1 We will only use any personal information you provide to us in accordance with our Privacy Policy. 14. Governing Law •14.1 These Terms shall be governed by and construed in accordance with the laws of the UK •14.2 Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the UK. 15. Amendments •15.1 We reserve the right to amend these Terms and Conditions at any time. Any changes will be posted on our website, and it is your responsibility to review them. By booking our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
Photographer Hire Terms and Conditions
TERMS AND CONDITIONS FOR BEAU EVENT PHOTOS These Terms and Conditions ("Agreement") govern the provision of photography services ("Services") by Beau Event Photos ("Photographer") to the client ("Client"). 1. Booking and Deposit •A non-refundable deposit is required to secure the Photographer's services for the event. No images will be released until full payment is received. •The deposit is due at the time of booking unless agreed otherwise. •The remaining balance is due before the event date. •If the balance is not paid by the due date, the Photographer reserves the right to cancel the booking and retain the deposit. 2. Cancellation •Cancellation by Client: oIf the Client cancels the event, the deposit is non-refundable. oIf cancellation occurs 45 days prior to the event date, 50% of the total fee is due. oIf cancellation occurs 21 days prior to the event date, 100% of the total fee is due. •Cancellation by Photographer: oIn the unlikely event that the Photographer is unable to attend the event due to illness, emergency, or other unforeseen circumstances, the Photographer will make reasonable efforts to arrange for a substitute photographer. oIf a substitute photographer is not available, the Photographer will refund all payments, including the deposit, to the Client. oThe Photographer's liability is limited to the refund of payments made. 3. Photography Services •The Photographer will provide photography services as agreed upon in the booking confirmation. •The Client is responsible for obtaining any necessary permissions for photography at the event venue(s). •The Photographer will have creative control over the shoot, but will follow the clients brief. •The Photographer is not responsible for any specific shots not taken due to circumstances beyond the photographer’s control. •Bad lighting and conditions may reduce the picture quality in some circumstances. 4. Editing •The Photographer will perform standard post-processing and editing on the images. •Standard editing includes colour correction, exposure adjustment, cropping, and sharpening. •Additional editing services, such as retouching or manipulation, maybe available for an additional fee, to be agreed upon between the Photographer and the Client. •The Photographer's editing decisions are final. 5. Supply of Images •The Photographer will deliver the edited digital images to the Client within 2-7 days after the event date unless prior agreement has been made. •Images will be delivered via a Pic-Time and Onedrive link. Each link will be time limited and extended subject to a possible fee. •The Photographer will maintain a copy of the images for a period of 6 months. After this time, the Photographer is not responsible for archiving the images. •The photographer is not responsible for the lifespan of any digital media provided or for any future changes in digital technology or media readers that might result in an inability to read files provided. 6. Copyright and Usage •The Photographer retains the copyright to all images created. •The Client is granted a personal and accredited commercial license to use the images. •The Client may publish and reproduce the images for commercial purposes. •The Photographer may use the images for promotional purposes, including display on websites, social media, and in portfolios, unless otherwise agreed in writing by the Client. No images of Children will be used by the photographer unless permission is given. 7. Client Responsibilities •The Client is responsible for providing the Photographer with a safe working environment at the event venue(s). •The Client is responsible for the behaviour of their guests and ensuring they cooperate with the Photographer. •The Client must inform the Photographer of any specific requests or important details prior to the event. •The Client is responsible for providing accurate event details, including dates, times, and locations. 8. Limitation of Liability •In the event of any loss, damage, or failure to deliver images due to circumstances beyond the Photographer's control, including but not limited to equipment malfunction, accidents, or acts of God, the Photographer's liability is limited to a refund of the fees paid by the Client. •The Photographer is not liable for any consequential damages. 9. Force Majeure •Neither party shall be liable for any failure to perform its obligations under this Agreement if such failure is caused by a Force Majeure Event. A "Force Majeure Event" means any event beyond a party's reasonable control, including but not limited to acts of God, war, riots, fire, flood, epidemic, or governmental action. 10. Agreement •This Agreement constitutes the entire agreement between the Photographer and the Client. •This Agreement may only be modified in writing, signed by both the Photographer and the Client. 11. Governing Law •This Agreement shall be governed by the laws of the UK. By booking the Photographer's services, the Client agrees to the terms and conditions outlined above.
